A single policy detail—who gets first claim on scarce AI chips—can shape the balance of power in defense and intelligence more than most speeches or summit photos.
That’s why the current fight over the GAIN AI Act deserves attention from anyone working in the “AI in Government & Public Sector” orbit: policy leaders, defense contractors, cloud and data center operators, and national security teams tasked with turning AI strategy into real capability. The stakes aren’t abstract. Compute is the fuel for training frontier models, running large-scale intelligence analytics, simulating weapons performance, and operating autonomous systems.
Here’s my take: Washington is at risk of making the wrong trade—protecting short-term commercial upside while slowing the very allied AI deployment the U.S. says it wants for national security.
The real bottleneck in defense AI is compute, not ambition
Answer first: If you want the U.S. and its allies to lead in defense AI, you have to treat advanced compute capacity as a strategic resource—because it is.
Many agencies already have pilots, prototypes, and “promising” demos. What they don’t have is enough reliable access to modern accelerators (and the power, cooling, and facilities to run them) to scale systems into production. In practice, compute constraints show up as:
- Delays moving from model experiments to fielded capabilities
- Longer training cycles for mission models (ISR fusion, targeting support, cyber defense)
- Inability to surge capacity during crises or conflicts
- Dependence on non-aligned infrastructure where supply chain and insider risks are harder to control
The defense community has learned this lesson repeatedly: capability doesn’t emerge from strategy documents. It emerges from supply, infrastructure, and governance.
In late 2025, the U.S. government is pushing an “AI exports” posture to extend American technology abroad. That’s not charity. It’s a security play—build the infrastructure footprint early, create standards and dependencies that favor U.S. ecosystems, and keep adversary stacks out of the critical path.
What the GAIN AI Act actually does (and why people misread it)
Answer first: The GAIN AI Act isn’t “chip hoarding.” It’s a two-part framework: (1) deny advanced chips to adversaries and embargoed states, and (2) speed exports for trusted U.S.-controlled deployments overseas.
A lot of the public debate collapses into a simplistic narrative: “Any restriction equals protectionism.” That’s not what’s being proposed.
Part 1: A “right of first refusal” aimed at countries of concern
The bill’s core mechanism is straightforward: when advanced AI accelerators are scarce, U.S. buyers get first priority before exports go to entities in “countries of concern” (including China and other designated categories such as state sponsors of terrorism or arms-embargoed states).
This matters because scarcity is real. AI accelerators aren’t like commodity servers you can order at will. Lead times, packaging constraints, high-bandwidth memory supply, and data center power availability all compress the market.
Strategically, prioritizing domestic demand before selling to adversarial markets aligns with a simple principle:
If compute is the bottleneck for AI leadership, you don’t sell the bottleneck to the competitor.
Part 2: A “trusted U.S. person” exemption that helps allies
This is the part many critics miss: the bill creates a pathway for trusted U.S.-controlled operators to move faster through export licensing when deploying chips to their own overseas data centers.
In practical terms, this is about enabling U.S. cloud and data center firms to build capacity in strategically important markets—without treating every project like an ad hoc exception.
The concept is: meet strong security standards (ownership limits for entities tied to countries of concern, audits, robust physical/cyber controls, and a compute footprint anchored in the U.S.), and in return, get reduced licensing friction.
That is exactly how you scale allied compute while keeping adversaries out.
Why allied AI infrastructure exports are a national security strategy
Answer first: Exporting the “American AI stack” to allies is less about selling chips and more about shaping the operating environment for defense and intelligence cooperation.
When U.S.-aligned infrastructure becomes the default in key regions, three things happen that matter directly to national security:
1) Interoperability becomes a baseline, not a special project
Combined operations increasingly depend on shared data, shared models, and shared infrastructure. If allies build on compatible U.S.-origin stacks (cloud primitives, model serving layers, monitoring, identity), coalition AI integration becomes faster and safer.
That has obvious implications for:
- Joint ISR fusion and maritime domain awareness
- Cyber threat intelligence sharing at machine speed
- Logistics optimization across coalition basing
- Coordinated counter-UAS and air defense modernization
2) Supply chain security improves through consolidation
Fragmented infrastructure creates fragmented risk. When allied compute is built on trusted operators with enforceable standards—audits, physical security controls, ownership transparency—you reduce the attack surface.
This is especially relevant for governments trying to balance sovereignty with operational need. “Data residency” debates often miss the bigger issue: who operates the infrastructure, under what controls, and with what monitoring.
3) Adversary tech ecosystems get boxed out early
The uncomfortable truth: infrastructure choices are sticky. Once a ministry, telco, or hyperscaler ecosystem commits to a vendor stack and builds talent around it, switching costs rise fast.
If the U.S. wants to prevent a “Digital Silk Road” effect in AI—where adversary-aligned platforms become the default in emerging strategic markets—then allied deployments need to be fast, scalable, and administratively smooth.
That’s why licensing friction isn’t a bureaucratic nuisance. It’s a strategic delay.
The political risk: confusing corporate revenue with national advantage
Answer first: The U.S. can’t run AI national security policy as a quarterly earnings optimization problem.
One reason this debate is so heated is that different parts of industry benefit from different policies:
- Cloud providers and data center operators generally want predictable pathways to deploy U.S.-controlled compute globally (especially in allied markets).
- Chip designers have incentives to preserve high-margin sales wherever demand is strongest—including places the U.S. government sees as strategic competitors.
Those incentives aren’t immoral. They’re normal.
But here’s the line policymakers have to hold: national security strategy has to set the rules of the market for strategic technologies, not the other way around. If compute access meaningfully affects military and intelligence advantage, then it sits in the same category as other controlled dual-use capabilities.
A second risk is pure governance: when policy reversals appear—especially late in the process—agencies and allied partners interpret it as uncertainty. Uncertainty slows procurement, slows co-investment, and drives partners to hedge.
And hedging in AI infrastructure usually means “buy whatever is available.”
If GAIN AI fails, the likely replacement could be worse
Answer first: Killing a targeted compromise often invites a blunt alternative that reduces flexibility for allies.
Congressional appetite for restricting adversary access to advanced compute remains strong. If a compromise bill that mixes denial with allied enablement collapses, lawmakers may shift to a stricter approach that:
- Broadly blocks licensing above certain chip thresholds
- Treats allied markets the same as non-aligned markets
- Removes executive branch flexibility
- Creates delays that affect legitimate U.S.-controlled deployments abroad
From a defense and national security perspective, that’s the worst of both worlds: adversaries still try to circumvent controls, while allies face slowed deployments and muddled partnership signals.

What leaders in defense and government AI should do now
Answer first: Don’t wait for Washington to “settle it.” Build compute resilience, export-readiness, and trusted deployment plans now.

1) Treat compute like a program dependency, not an IT detail
If your AI roadmap doesn’t include a compute acquisition plan, it’s not a roadmap.
Operationally, that means:
- Forecasting accelerator needs per mission portfolio (training vs inference)
- Locking in capacity reservations where feasible
- Building cost models that include power, cooling, and facility retrofits
- Designing for multi-cluster deployment so you can surge or relocate workloads
2) Build “trusted operator” readiness into contracts and architectures
Whether or not any particular bill passes, the direction of travel is clear: more scrutiny, more auditing, more provenance requirements.
What works in practice:
- Zero trust patterns for model pipelines and data access
- Hardware attestation and tamper-evident logging for critical workloads
- Clear ownership and control clauses for overseas deployments
- Security controls that can survive an audit without heroics
If you can’t explain where your compute runs, who administers it, and how you prevent insider abuse, you’re not ready for mission-grade AI.
3) Align allied deployment plans with energy and infrastructure reality
One underrated constraint is power. Regions with surplus generation and rapid data center build capacity will outpace everyone else.
For national security partnerships, a smart approach is to prioritize:
- Sites with reliable energy and grid stability
- Locations with secure physical access and vetted staff pipelines
- Jurisdictions where U.S.-aligned operators can enforce controls
This isn’t just about siting. It’s about ensuring that allied compute is actually usable during crises.
4) Create a policy-to-operations translation team
Most organizations get this wrong: policy monitoring lives in legal or government affairs, while engineers learn about changes after the fact.
A small cross-functional cell—export compliance, security, procurement, and engineering—can quickly answer:
- Are we affected by new thresholds or license categories?
- Which deployments slow down, and which speed up?
- What redesigns reduce future licensing friction?
