A smart move for B2B startups: provide a “workplace deployment kit” (short plain-English explanation, FAQ, what data is used, what humans do, how to contest outcomes). It reduces resistance and protects adoption.

Classification and guidance: where startups should be cautious

Answer first: High-risk classification hinges on intended purpose; if you’re close to the line, document your reasoning and design for auditability anyway.

Annex III lists sensitive uses across employment, education, migration, justice, and biometric identification. The Commission has said guidance with practical examples is coming, and that clarity will help businesses classify systems consistently.

Until guidance is fully settled, the safest approach for UK startups is:

  • Assume scrutiny if your AI touches protected groups, essential services, or rights-heavy decisions.
  • Document your classification decision the same way you’d document a security risk assessment.
  • Avoid marketing overreach. Don’t claim your tool “ensures fairness” unless you can prove it under realistic conditions.

Penalties are designed to focus minds: fines can reach €35m or 7% of global turnover for banned practices, with lower thresholds for other breaches. Startups won’t like the numbers, but the bigger commercial impact is earlier: enterprise customers won’t buy what they can’t defend.

Turning EU AI Act readiness into a UK growth advantage
